– hereinafter referred to as the 'Provider' –

and

– the buyers specified in § 3 (hereinafter referred to as the 'Buyer') –

§ 1 Scope and Basis of Agreement

1. These GTC of the Provider apply to all business relations between the Provider and the respective Buyer regarding all services of the Provider.

2. Deviating terms and conditions of the Buyer are not recognized unless the Provider explicitly agrees to them in writing.

§ 2 Services

The Provider sells products of Private Alpha Switzerland AG on its internet platform. These include exclusively digital products. Details can be found in the respective product description.

§ 3 Buyers

1. Buyers can be consumers as well as entrepreneurs.

2. A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to their commercial nor to their independent professional activity.

3. An entrepreneur is a natural or legal person who acts in the exercise of their commercial or independent professional activity when concluding a legal transaction.

4. The services may only be used by persons of full age and unlimited legal capacity.

5. The offer is aimed exclusively at Buyers in the EEA and Switzerland.

§ 4 General Provisions for Orders

1. The product presentation does not constitute a binding offer.

2. The Buyer submits a binding offer by clicking 'Order Now' in the last step. The contract is concluded by a separate acceptance email from the Provider.

3. The Buyer can abort the process at any time before completion.

4. Subscriptions are automatically renewed for one year if not cancelled four weeks before the end.

§ 6 Orders of Digital Products

1. Provision is made by the Provider by email or in the customer account.

2. The Buyer receives a simple, non-transferable right of use for their own information purposes.

3. Unlimited data availability cannot be guaranteed; local storage is recommended.

§ 8 Prices, Maturity and Payment

1. The prices at the time of the conclusion of the contract including VAT apply.

2. Payment is made in advance.

3. Payment options: Invoice, Credit Card, PayPal or Stripe.

§ 9 Warranty and Liability

1. The Provider is liable for material defects in accordance with legal regulations.

2. The Provider is not liable for damages resulting from high-risk investments.

§ 12 Risk Disclosure

Investments in financial instruments are associated with risks. The total loss of the capital used cannot be excluded. Past performance is no guarantee for the future.

REVOCATION POLICY

Right of Revocation

You have the right to revoke this contract within fourteen (14) days without giving reasons. The period begins from the day of the conclusion of the contract.

Consequences of Revocation

In the event of revocation, all payments received will be repaid immediately, at the latest within 14 days.

Premature Expiration

The right of revocation expires prematurely for digital content if execution has already begun with your express consent.

§ 13 Final Provisions

1. Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

8. The place of jurisdiction is Lucerne/Switzerland, to the extent legally permissible.
